Racecar driver and GoDaddy spokeswoman Donica Patrick recieved a traffic ticket in Scottsdale earlier this month. According to news reports, this is the second ticket she recieved this year. She will be requied to appear in Scottsdale City Court next week for an arraignment. It does not appear that she was issued a complaint for criminal speeding so a fine is all that will likely be imposed. Rapper DMX enters into plea agreement in court today

Rapper Earl Simmon aka DMX appeared in Maricopa County Superior Court this morning and entered a guilty plea on counts of theft, animal cruelty, possession of marijuana and possession of narcotic drugs.  He will be sentenced next month.  His charges stem from multiple investigations including a raid of his Cave Creek residence and an incident at Mayo Hospital where he provided a false name to allegedly avoid financial responsibility for his medical treatment.

A city court judge has suppressed the breath results in approximately 70 additional cases based on the refusal of Intoxylizer 8000 manufacturer CMI to release the source code for the machines. Not only has CMI failed to release the information, President Toby Hall has disregarded a court order requiring him to personally appear. A new hearing has been set for December 5th. DUI defense attorneys have challenged the accuracy and reliability of these machines.

Chandler police officer Tom Lovejoy was acquitted earlier this year after Maricopa County Attorney Andrew Thomas and Sherriff Joe Arpaio prosecuted him for animal cruelty after his dog died in a tragic accident. Obviously displeased with the outcome of his publicity stunt guised as a criminal prosecution, Andy Thomas is now considering adding Office Lovejoy to a blacklist for police officers who have integrity issues.
Lovejoy has stated that it is his belief that the measure is being considered by Thomas as retaliation for having lost the criminal case. In response, Thomas office claims that Lovejoy is being considered for the list based on an allegation that he and numerous other cops improperly used an official computer database to research information. Curiously, Lovejoy is the only officer from that investigation that is being contemplated for the blacklist.
The list contains the names of officer who have various issues in the backgrounds pertaining to their credibility. If an officer is listed and they are expected to be called as a witness in a case being prosecuted by the county attorney, the information pertaining to the officer is usually provided to the judge who will then determine whether the defense attorney will be entitled to view it.

A pending court case in pima county superior court could have wide-ranging consequences for thousands of other DUI defendants throughout Arizona including those charge with DUI in Phoenix, Scottsdale, and Tempe. At issue is the “source code” or the computer program that the machine uses everytime it is operated. The machines are manufactured by company CMI who has repeatedly ignored court orders requiring them to disclose the code to DUI defense attorneys. Phoenix DUI attorneys believe that if the code is subjected to scrutiny and any errors or bugs are found, DUI cases may be dismissed if they are based on results from these machines.
The court has given CMI until November 24 to demonstrate good cause why it should not be held in contempt for failing to honor the courts order requiring it to disclose the program and make it available for Arizona DUI defense attorneys. Depending on what happens next week, DUI cases throughout Phoenix, Glendale, Tempe, Mesa, and Scottsdale could be affected. Joshua S. Frank Bernal sentenced to 27.5 years in prison

City of Phoenix law enforcement officers have expressed thier gratitute to the prosecutors office for their efforts in convicting a defendant who used a gun to fire bullets at 2 policemen in October of last year.
Then 22 year old defendant is named Frank Bernal and the court imposed a sentence of 27.5 years in the state prison. According to the police officers, Mr. Bernal fired five times at Officers Shane Figueroa and Brent Freyberger while the three men were located in an alley located in West Phoenix. Fortunatley, niether of the officers were shot and no injures were suffered. The officers were able to arrest the defendant after they chased him on foot. Deputy Maricopa County Attorney Gina Godbehere justified the long sentence on the basis that the defednat was trying to kill the officers. She claims that Mr. Bernal stated ‘I should have killed you,’ to one of the police officers when the apprehended him after the chase. Mr. Beranal allegedly also made reference in superior court while being sentencned abuot lookingh forward to visiting his friends in prison. Officers from the agency invovled in the incident were very pleased with the way the case was prosecuted by the county attorney’s office.

In Phoenix, Arizona, the former head prosecutor responsible for felony criminal cases such as DUI, possession of drugs, domestic violence, aggravated assault and forgery, is an attorney named Rick Romley – a republican.  The Arizona republic is today reporting that he is crossing party lines to support Tim Nelson for the next county attorney.  Given that Andrew Thomas is woeful unfit for his current position, has compromised the office’s relationships with police departments and various judges, has allegedly paid millions of taxpayer dollars to his former employer (who notoriously blundered the ill-conceived New Times case), and wasted tens of thousands of tax payers dollars on thinly veiled campaign propaganda such as his “crime prevention” handbook, the announcement is hardly a huge shock.  Although Thomas and his team of political hacks have been attacking Mr. Nelson’s support from various criminal defense attorneys, other opponents of Thomas include
