Former chief Maricopa County prosecutor endorses Nelson

In Phoenix, Arizona, the former head prosecutor responsible for felony criminal cases such as DUI, possession of drugs, domestic violence, aggravated assault and forgery, is an attorney named Rick Romley – a republican.  The Arizona republic is today reporting that he is crossing party lines to support Tim Nelson for the next county attorney.  Given that Andrew Thomas is woeful unfit for his current position, has compromised the office’s relationships with police departments and various judges, has allegedly paid millions of taxpayer dollars to his former employer (who notoriously blundered the ill-conceived New Times case), and wasted tens of thousands of tax payers dollars on thinly veiled campaign propaganda such as his “crime prevention” handbook, the announcement is hardly a huge shock.  Although Thomas and his team of political hacks have been attacking Mr. Nelson’s support from various criminal defense attorneys, other opponents of Thomas include

Republican Grant Woods, a former state attorney general, former U.S. Attorney Paul Charlton, a Republican; Attorney General Terry Goddard, a Democrat; former U.S. Attorney Jose Rivera, a Democrat; and Napolitano, a Democrat and former attorney general and U.S. attorney; Pima County Attorney Barbara LaWall, Pinal County Attorney James Walsh, Navajo County Attorney Melvin Bowers, Santa Cruz County Attorney George Silva, and Yuma County Attorney Jon Smith.

Trial begins today in Phoenix for the alleged serial shooter

Trial began today with the prosecution’s opening statements in State of Arizona v. Hausner.  The defendant is charged with 87 felony counts including murder, drive by shooting, aggravated assault, conspiracy, and a weapons offense.  Trial is expected to last through the summer and it is anticipated that at least one of the defendant’s accomplices will testify on behalf of the state of Arizona.  The defense attorney is expected to make his opening statements in court to the jury tomorrow.  If you or a loved one is in need of a criminal defense attorney in Phoenix, Arizona click here.

OJ Simpson was convicted of kidnapping and robbery last week.  He was taken into custody and is being held without bond pending his December 5, 2008 sentencing date.  With Simpson behind bars and reportedly focusing closely on the appeal of his recent criminal convictions, his search for the real killers of his ex-wife will be placed on hold.  www.jdavidsonlaw.com

Third high profile loss for top county prosecutor

It appears that the Maricopa County Attorney’s Office in Phoenix has been to preoccupied charging illegal immigrants with forgery for having a fake drivers license bearing their own name and wasting RICO funds to produce & distribute Mr. Thomas’ reelection campaign materials…. errrr… I mean crime prevention handbook, that even the top prosecutor of their pretrial conviction is having a hard time getting a conviction in court.

Three recent high profile cases handled by Lisa Aubuchon have failed to result in a conviction. 

Chandler K9 police officer was charged in Maricopa County Justice Court with the misdemeanor crime of animal cruelty.  At the conclusion of the trial, the judge acquitted Officer Lovejoy because the State had failed to meet its burden of proof.

In yet another politically motivated prosecution, the county attorney recently charged the owner of Ajo Als with a criminal offense for allegedly violating the county’s health code.  Once again, Ms. Aubuchon was the prosecutor assigned to the case.  Arcadia Justice Court Judge Michael W. Orcutt reportedly threw the case out of court after four hours of court testimony.  (as a side note, the Phoenix Police Department reports that there were 101,485 violent and property crimes reported in Phoenix alone last year.  Why is the prosecutors office wasting its valuable resources pursuing these civil matters as a criminal offence?  Simply put, the interests of the citizens and the taxpayers secondary to Mr. Thomas’ political ambitions.)

Most recently, Ms. Aubuchon failed to obtain a guilty verdict in the prosecution of ACLU legal director Dan Pochada for his alleged criminal trespassing in Phoenix at a political rally last fall.

With their apparent difficulty in obtaining a guilty verdict in misdemeanor cases prosecuted by one of their top attorneys, individuals in Phoenix should seriously question how the county attorneys office is handling more serious offenses (such as drugs, assault, DUI, and theft), particularly given the manner in which Mr. Thomas basically gutted the once acclaimed training program for new attorneys and the completely out of touch plea policies in place forcing attorneys to take cases to trial that lack necessary evidence.

Seeking re-election, Andrew Thomas fans the flames of the illegal immigration debate with the release of his skewed study.

Maricopa County attorney Andrew Thomas, who reportedly has himself never conducted a criminal jury trial, is seeking reelection this year and is trying to distract the attention of the media and the voters away from the numerous scandals plaguing his office including the ongoing bar investigation, the untold fortune that was paid to his former employer and the record number of cases being dismissed due to his sound-bite friendly yet unrealistic plea policies.  According to the Arizona Republic, Maricopa County Attorney Andrew Thomas stated at the today press conference that the study establishes a link between illegal immigration and crime.

The results of Mr. Thomas’ “study” demonstrates that illegal aliens commit approximately 20% of the felony offenses in Maricopa County.  These numbers are approximately twice that of studies conducted separately by Arizona State University and the Arizona Republic.

So how did Andy skew the numbers?  Simple. 

The county attorneys “research” is based on convictions, not arrests or bookings.  The earlier mentioned studies which showed that illegal aliens commit only 10% of the crimes in Phoenix and throughout Maricopa County looked at arrests and bookings.  The distinction is of significant importance because the majority of illegal aliens are not eligible for bond pursuant to Proposition 100.  Meaning, among other things, that the defendants who are held on felony charges without bond are forced to wait for their trial date in the less than hospitable Maricopa County Jail.  This author has represented dozens and dozens of illegal aliens who opted to give up their right and plea guilty rather than sit in Sheriff Joe’s jail for 4 months or longer waiting for trial.  Many if not most of these persons accused of criminal offenses in Phoenix, Maricopa County Arizona would have taken their cases to trial if afforded the opportunity to remain out of custody in the meantime.

Reasonable minds may differ as to whether illegal aliens should or should not be eligible to be released on bail while pending felony charges in Arizona.  But right or wrong, these defendants plead guilty with much greater frequency than those who are legally in the country.  Because these guilty pleas are included in the county attorney’s “conviction rate”, Andy’s latest “research” is skewed at best and deceptive at worst.

The Maricopa County Attorney also fails to mention that many of the felony offenses factored into his study, such as certain forgery offenses and certain weapons related offenses are only be charged against illegal aliens.

With a horrendous record of experienced prosecutors leaving his law office since 2004 and the recent loss of several high profile cases, Maricopa county attorney Andrew Thomas is again going back to the immigration well.  Hopefully the voters this year will see Mr. Thomas’ scapegoating for what it is.

Phoenix criminal defense attorney Jason Keller was arrested today and booked into the jail on allegations that he smuggled drugs and a cell phone into the county jail.  According to police reports, he provided at least some of the items to existing clients and/or convicted gang members.
